Applicable to distance selling

Article 1 – Applicability of the terms

The seller SHS is hereinafter defined as SHS Computer SPRL and SHS Multimédia SPRL, whose registered office and place of business are located at Chaussée Freddy Terwagne 2a, 4480 Hermalle-sous-Huy, registered in the register of legal entities under the numbers 0475.215.173 and 0889.321.635 respectively.

The buyer is hereinafter defined as the company or person who signs and accepts these terms of sale.

The information on the website, in price lists and in emails may be changed by the seller without prior notice. Placing an order or accepting an offer from the seller implies the unconditional acceptance of these general terms. These general terms may be amended by the seller at any time and without prior notice; the amendments then apply to all subsequent orders.

Article 2 – Orders

Offers are valid while stocks last.

2.1 Product description

The essential features of the product are stated on the website.

2.2 Availability of products

You are informed of product availability directly on the website. If an ordered product is not available, SHS may supply you with a product of equivalent quality and price. In that case, if you exercise your right of withdrawal, the return costs are at our expense. You nevertheless retain the option of cancelling the sale and requesting a refund (which will take place within a maximum of 15 days from the date of receipt of the goods). For products not held in our warehouses, our offers are valid subject to availability from our suppliers.

2.3 Steps to conclude the agreement

For a first order placed online, every new customer must create a “Customer account” with a username and a password. With each order confirmation you are redirected, over a secure connection, to your account, with a summary of your order. Your order is only definitively registered after the final confirmation. When you register the order, SHS receives it by email and the sale is deemed concluded once payment has been received in our account. Receipt of your order is confirmed by sending an email to the email address provided when the customer account was created.

2.4 Cancellation of the order

Orders on our website are automatically cancelled if no payment is received in our account.

Article 3 – Prices

The prices on the website are stated in euros, including all taxes, excluding delivery costs. They may vary, in particular due to exchange-rate fluctuations against the euro. The prices appearing on your order after validation and registration are fixed and final. If prices fall a few days after the order, we can under no circumstances compensate you for the price; if prices rise, we undertake to deliver to you at the price set on the day of the order, except in the event of a stock shortage and new supply from our suppliers. The amount of the delivery costs is calculated automatically for each order and is stated in the summary of your order before final registration.

Article 4 – Delivery and transport

SHS has chosen Bpost, a division of De Post, as its delivery partner. If you are absent during a delivery by Bpost, a notice is left in your letterbox and you are invited to collect the parcel within 15 days at your local post office. The delivery costs, which are minimal, depend on the weight of the parcel and the chosen shipping method, including insurance for the actual value of the shipped parcel.

4.1 Delivery times

Delivery takes place at the address you provided when placing the order. SHS undertakes to deliver to you within a maximum of 10 days, counting from the day following the day on which your payment is received. SHS does not make partial deliveries.

4.2 Delivery delay

In the event of a delivery delay, we recommend checking the status of your order directly online on the carrier's website using the tracking number, before contacting us. We ask you to notify us in writing of any delay of more than 3 days relative to the announced delivery time. In the event of force majeure or events such as lock-out, strike, total or partial work stoppage at the seller's factory or at its suppliers, epidemic, war, requisition, fire, flood, interruption or delay in transport, or legal or administrative measures preventing, restricting, delaying or prohibiting the manufacture or import of the goods, the seller is released from all responsibility for delivery. In all cases, delivery within the time limits can only take place if the buyer has fulfilled its obligations towards the seller.

4.3 Risks associated with transport

SHS bears the risks associated with transport up to delivery, i.e. up to the physical transfer of the goods to the recipient named on the order or their representative, provided that you check the goods on receipt in the presence of the carrier and, if necessary, note in writing on the consignment note any reservations found.

4.4 Receipt of goods

On receipt of the goods, the buyer is requested to check the good condition of the parcel and the conformity of the delivered goods in the presence of the carrier. The buyer must note any reservations on the delivery note. The buyer must refuse the delivery if the goods are damaged, missing, or if the parcel has been opened or repackaged. Goods accepted by the recipient without reservation are deemed to have arrived in good condition, in conformity with the order, and complete.

Article 5 – Complaints and customer service

For complaints you can get in touch at info@smartlaptops.nl. All complaints regarding a defect in the delivered goods, an inaccuracy in the quantities or an incorrect reference must be reported to the seller by registered letter within 7 calendar days of receipt of the goods.

5.1 Return number required

Returning goods is done exclusively by post, unless otherwise stated. Every return requires the prior authorisation of SHS and a return number, which can be obtained free of charge via info@smartlaptops.nl. After obtaining the return authorisation, the buyer has 7 days to return the defective goods. The following information is generally required: exact contact details, description of the part or parts, serial number, identified defect and the corresponding invoice number.

5.2 Original packaging required

Every defective product must be returned in its original packaging, together with all accessories and the return number clearly visible on the parcel. Any incomplete, damaged or insufficiently packaged product will not be taken back, exchanged or refunded.

5.3 Refund

Any refund request can only be processed after the returned products have been received by SHS. The terms are as follows:

  • Parcel returned at the customer's initiative: refund of the product; return costs are borne by the customer.
  • Parcel returned due to the company's responsibility (non-conformity, parcel not arrived, etc.): refund of the product and the shipping costs.

Article 6 – Right of withdrawal (private individuals only)

In the context of a distance sale, the private buyer has the right to inform SHS that they are withdrawing from the purchase. They must do so by registered letter within 14 calendar days, counting from the day following the day of delivery of the goods. Any return request outside this period cannot be accepted.

The buyer must return the goods in their original condition and packaging, unopened and undamaged (factory seal applied by the product manufacturer). The goods must be accompanied by a copy of the purchase invoice.

For products made to the consumer's specifications, products that are no longer saleable due to the consumer, or products that have been used by them, it is no longer possible to withdraw from the purchase. If the goods have not been unpacked, opened or damaged, SHS has 15 days to refund the purchase, with the exception of the shipping costs, which remain at the customer's expense.

Professionals do not have this right of withdrawal.

Article 7 – Warranty

Our agreements are governed by Belgian law. The Belgian courts have jurisdiction.

7.1 Manufacturer's warranty

For products with a specific manufacturer's warranty, the customer must contact the manufacturer directly, without the involvement of SHS. Our company refuses any return of goods in this context.

7.2 SHS commercial warranty

SHS offers a commercial warranty for a maximum duration of 11 months, unless otherwise stated. Software, video games, books, consumables, cartridges and data carriers (CD, DVD, etc.) are not covered by the SHS warranty. Batteries, LCD monitors and laptop screens are covered by the manufacturer's warranty.

7.3 Limitation of warranty

The seller's warranty is limited to the repair, replacement or refund of goods recognised as defective, taking their use into account, at the seller's discretion. The warranty does not cover labour costs, nor the costs resulting from dismantling, assembly and transport work. The warranty does not apply if the serial numbers have been damaged, moved or removed.

7.4 Warranty exclusions

The warranties exclude damage of external origin, damage resulting from improper use of the products, and damage resulting from the intervention of a repairer not approved by SHS or the manufacturer. SHS can under no circumstances be held liable for the loss or corruption of data or programs on materials returned for technical intervention.

7.5 Legal warranty

You also benefit from the legal warranty for hidden defects in the products sold and for defects in the conformity of the goods with the agreement (Law of 01/09/2004 on consumer protection in the sale of consumer goods). The buyer must notify the seller by registered letter of the existence of the lack of conformity within 2 months of the day on which the buyer discovered the defect.

Article 8 – Retention of title

The goods delivered and invoiced to you remain the property of SHS until the full price has been paid. Non-payment may lead to the reclaiming of the goods by SHS.

Article 9 – Payment

9.1 Payment methods

Payments must be made in such a way that the seller has the amounts at its disposal on the day the invoice is drawn up. Unless special provisions on the website apply, payment is made in advance by bank transfer.

9.2 Late payment

In the event of legal proceedings, the seller has the right to demand from the buyer the reimbursement of all costs associated with the procedure.
